| I am writing hoping you can tell me where to go and what to do. I am a smoker of forty one years old and the place where I am employed has posted non-smoking pamplets all over the work place. We are not allowed to smoke on premises because they say cigarrettes take away our ability to preform our duties, as a non-smoking employee does. I am employed at Lowes Home Improvement Stores and now they have informed us that any smoker employed by Lowes caught on Lowes Premises will be terminated immediately. How can they do this when they hired me smoking and knew I smoked from day one. This is discrimination and I am not the only one this is happening to. Some are afraid to speak up for fear of loosing their jobs. I need my job and I feel that I smoked when they hired me and I have done my duties with no problem so where do they get off telling me that I can no longer smoke on the premises, not even outside on a break. Please help me find out where we write letters to and who do we contact to let these idiots know that I do not tell them when to go to the rest room so they ought not be able to dictate to me that I can not smoke. People who patronize the store are not told to not smoke on Lowes Property so how can they get by with this bull crap. | |||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||||
As an adult on the shady side of 60 I have had the opportunity to watch this whole Anti-Smoking campaign evolve over the past 30 years. It is a little scary.
Any person or organization that dares to object or voice opposing viewpoints is instantly attacked and silenced. The tobacco companies and tobacco farmers have been labeled murderers and worse. Has this been an interesting experiment in social control? I hope not!
When you have some time, pick up Erick Fromms' book on aggression. He gives a detailed account of an experiment that was conducted to test people's response to authority figures. Sixty seven percent of the individuals tested continued following orders, even when they were told they were causing pain to the "Subject". Sheep are wonderful animals, aren't they?
After 30 years and billions in taxpayers cash spent, what has been conclusively proven?
Tobacco is Addictive. I believe most of us were already aware of that.
I am scared, however, by any person or group that uses labels, ridicule, or intimidation to suppress opposition in the name of "Good Intentions".

There are a lot of groups that are tired of smokers being treated as second class citizens, but it appears that smokers are loosing the battle. When you deal with businesses and Government there are a few ways to beat them at their own game.

I am outraged to read that Mongomery County, MD is considering banning
smokers from smoking in their own home if their neighbors object. I thought
this was a free country! This violates a person's rights IN THEIR OWN HOME.
Never have I heard anything like this and soon, if this passes, we will not
even be allowed to smoke outside. I am furious about this as it violates our
civil rights and I wonder where the ALCU s now! They defend everyones rights
but are silent on smoking.

My government office building just became smokefree on 11-9-01 and my problem is the smokers have no where to smoke outside that provides any shelter. I have been told that OSHA says that the government has to provide shelter for the smokers. If you have any information or can tell me where to find the information that will back me up when I attend the Commisioners meeting please let me know as soon as possible because I intend to voice my opinion.

I believe I heard that a ruling in the United States approved states rights
to maintain laws which disqualify individuals who use tobacco products from
employment and if found using tobacco even away from work, firing them, with
the premise that studies show smokers take more breaks and more sick days.
Is this true?
I wonder what already exists or will come next when it comes to excluding
individuals from employment.
Do studies define breaks as going outside to smoke and exclude gatherings at
the coffee pot or in the hallway or at the water cooler?
Do studies know smokers profiles based on race or income or education level?
How does being a smoker and being "legally" disqualified from employment
correlate with race and income level?
Is this race discrimination?
Is this income discrimination?
I believe tobacco company targeted advertising, race and income based, and
vulnerability to societal stigmas based on those factors affect who uses this
addictive legal drug.
Will coffee drinkers be "profiled"?
Will alcohol users be "profiled"?
Will vitamin and herbal supplement users be profiled?
Will red meat eaters be profiled?

I am smoker and I live in a condo complex in California. I recieved a letter
from the Management Company that I am not allowed to smoke on my patio or in
front of my building because of one person who leaves there bedroom window
open doesn't like the smell. How can I approach this situation legally to
have the freedom of smoking outdoors on my own patio and complex? Please
repond as soon as possible so I may clear this matter.

I live in El Paso, TX. In June the City Council is
going to decide whether or not the establishments here in this city will be
smoke-free. The most frightening thing about the decision they are going to
make is that it infringes on our rights. If we let them tell us how to run
our OWN businesses, where will it stop? It may be my connection but I am
having trouble getting to the AIR or ASA web sites. If you can help me in
any way please let me know. I am planning to write a letter to the editor of
our newspapers even though everyone is sure the smoking ban will pass. I
have many non-smokers on my side.

I just recently got a job at a store where they don't allow any cigarette
breaks. Is this legal?

I live in Tennessee and was wondering if you know if there are any laws
about smoking
in the workplace. We have smoking areas outside. There is a problem
with smokers
not having to make their time up whereas people going to the doctor do
not get paid
and have to make time up. Can our employer remove our privilege to
smoke during
working hours?

My employer has told everyone that they MUST be 200 feet
away from the business if they wish to smoke. Is this
legal? And if not how far does one have to be? I
live in California and work in Irvine.
